Bylaws Update

APCO Employees Credit Union is committed to protecting its membership by avoiding frivolous lawsuits so prevalent in today’s business world. Therefore, beginning March 1, 2013 the following term will apply to existing Visa, debit card, MAP, share account, checking, and open end loan agreements:

Arbitration – Any controversy or claim arising out of or relating to accounts, loans, or other relationship with the Credit Union, or breach thereof, shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Any judgment or decision as a result of any such arbitration proceeding may be entered in any court having jurisdiction thereof. APCO retains all rights before, during, or after any arbitration, including: 1) all court remedies, such as injunctive relief; 2) all self-help remedies, such as repossession or setoff; 3) foreclosure of property; 4) exercise any rights under an agreement; 5) the right to proceed with collection through all other legal methods, including proceeding in court to obtain a judgment. For VISA cards, if you disagree with the changes, return the card to us and the same terms will apply. Holding or using the card after the effective date constitutes consent to changes.
